Terms and conditions
The terms you are agreeing to when you buy, rent or have equipment installed by us. Written to be read rather than skipped.
Who we are
Westin Healthcare Inc is a medical equipment supplier, installer and rental company established in 2012, operating from Unit 7, 15 Fisherman Drive, Brampton, Ontario, L7A 1B7.
We supply, deliver, install, service and rent mobility and homecare equipment across the Greater Toronto Area, and ship purchases across Canada. In these terms, "we" and "us" mean Westin Healthcare Inc, and "you" means the customer named on the quote or invoice.
By placing an order, accepting a quote, or having equipment delivered or installed, you agree to these terms.
Quotes and orders
Quotes are provided in writing and are valid for the period stated on them. Where no period is stated, a quote is valid for 30 days, after which manufacturer pricing and availability may have changed.
A quote becomes an order when you accept it in writing or in person and any required deposit is paid. For custom and installed equipment, manufacture does not begin until that point.
Prices shown anywhere on this website or in general marketing material are indicative only. The price you pay is the one on your written quote, which is prepared after we have measured and assessed what you actually need.
Pricing, taxes and payment
Prices are in Canadian dollars and exclude applicable taxes unless stated otherwise. Taxes are shown separately on your invoice.
We accept Visa, Mastercard, American Express, Discover, Interac, and cash on delivery within the GTA. Where a funding program is paying part of the cost, you pay only the balance and we bill the program directly.
For custom, special order and installed equipment, a deposit is normally required before manufacture begins, and the balance is due on completion of installation. The amounts are stated on your quote.
Where a deposit has been paid on custom or made-to-order equipment and you cancel after manufacture has begun, costs already incurred with the manufacturer may not be refundable. We will always tell you what stage an order has reached before you decide.
Delivery and access
We deliver, assemble and demonstrate equipment ourselves across the GTA rather than using couriers. Purchases outside the GTA ship by carrier from Brampton.
Delivery dates are our best estimate and are given in good faith. They depend on manufacturer lead times, freight and, for installations, permits and inspections. We will tell you promptly if a date moves and why.
You are responsible for telling us about access constraints: narrow doorways, stairs without a landing, restricted parking, elevator booking requirements in a condominium, or anything else that affects getting equipment into the room it is going in. We check what we can at the assessment, but we rely on you for what we cannot see.
Installation and permits
Installed equipment, including stairlifts, ceiling lifts, platform lifts, ramps, grab bars and bathtub cutouts, is fitted by our own technicians rather than subcontractors.
Installation is quoted on the basis of the site survey. If something is discovered during installation that could not reasonably have been seen at the survey, such as unsound concrete, hidden water damage or non-standard framing, we will stop, explain it and give you a revised price before continuing.
Where a permit is required, we prepare the drawings, submit the application and coordinate the inspection. Permit fees are itemized on your quote. Timelines for permits are set by the municipality and outside our control.
Fixing into a building leaves fixings and requires making good. We will explain at the survey what the finished result looks like. Restoring decorative finishes beyond making good is not included unless your quote says so.
Free assessments
Our home assessments carry no charge and no obligation. A consultant attends, measures, discusses the options and leaves a written quote.
An assessment is a commercial recommendation about equipment. It is not a clinical assessment and it is not a substitute for advice from an occupational therapist, physiotherapist or physician. Where funding requires a registered authorizer, that is a separate assessment which we will help you arrange.
Funding applications
We are an authorized vendor for the Assistive Devices Program, the Ontario Disability Support Program, WSIB, March of Dimes Canada, Veterans Affairs Canada, the Interim Federal Health Program and BlueCross.
We complete and submit funding applications on your behalf and follow them up. We do not control whether a program approves an application, how much it contributes, or how long it takes, and we do not guarantee any of those things.
We will tell you honestly at the outset which programs are realistic for your situation, including when the answer is that none apply. Where an application is refused, you remain responsible for the full price unless we agree otherwise in writing.
Warranty and servicing
Equipment carries the warranty offered by its manufacturer. Terms vary by product and are confirmed in writing with your quote and invoice. We do not publish warranty periods on this website because doing so accurately for every product is not possible.
If something fails, contact us rather than the manufacturer. We handle the claim and we service what we sell, from Brampton, across the GTA.
Warranties generally require that equipment is used as intended and maintained as recommended, and they generally exclude consumables such as batteries, tires, sling fabric and upholstery, along with damage from misuse, neglect or unauthorized modification.
Servicing outside warranty is chargeable at our current rates, which we will quote before attending wherever possible.
Safe use and your responsibilities
We demonstrate every piece of equipment we deliver or install and we will not leave until whoever is using it, and whoever is caring, has operated it themselves with us present.
After that, safe use is your responsibility. That means using equipment within its stated weight rating, following the manufacturer’s instructions, keeping up recommended maintenance, and not modifying it.
Weight ratings matter more than people expect. Where a lift and a sling, or a bed and a mattress, have different ratings, the lower of the two governs the whole system. Tell us the weight of the person using the equipment so we can specify correctly.
Liability
We take responsibility for our own work: the equipment we supply being as described, and our installation and servicing being carried out competently.
To the extent permitted by law, our total liability in connection with any order is limited to the amount you paid for the equipment or service concerned. We are not liable for indirect or consequential losses.
Nothing in these terms limits liability that cannot be limited under Ontario or Canadian law, including under consumer protection legislation, or liability for death or personal injury caused by our negligence.
Your information
We collect only what we need to advise you, supply equipment, submit funding applications and service what we sell. How we handle it is set out in our privacy policy.
Funding applications require us to share relevant information with the program concerned. We will tell you what is being submitted and to whom.
General
These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable in Ontario.
We may update these terms. The version that applies to your order is the one in effect when the order was placed. The date at the top of this page shows when it was last revised.
If any provision of these terms is found unenforceable, the remaining provisions continue to apply.
Where your signed quote, invoice or a manufacturer’s warranty document says something different from this page, that document governs.
Questions about this policy
If any part of these terms is unclear, ask us before placing an order. Nothing here is intended to be a surprise, and where our written quote says something different, the quote governs.
* These terms and conditions are subject to change at any time without prior notice. The version in effect at the time of your order is the one that applies to it, and the date at the top of this page shows when this page was last revised.
This page is written in plain language so it can be understood without a lawyer. It is a summary of how we operate and it does not constitute legal advice. Where a signed quote, invoice or manufacturer warranty says something different, that document governs.
